Burning Permit Policy

Open burning is allowed under following conditions:

  1. Between October 1 and May31
  2. Apermit must be obtained
  3. The Permit holder shall have adequate fire protection equipment in place - rake, shovel, hose, tractor, disk, etc.
  4. Weather conditions do not exceed any of the following:
    1. Temperature above 90 degrees
    2. Wind above 10 MPH
    3. Humidity below 15%
  5. Permit holder is not burning any prohibited materials
  6. The State Fire Marshal has not prohibited open burning
  7. No burning after Dark!

Open burning includes any burning outdoors. ! fire in a "burn barrel" is open burning as well as burning debris in a fireplace. A permit holder may burn in an incinerator only after the incinerator has been inspected by the Fire Chief or designee

It is against the law to conduct any open burning that:

  1. Unreasonably interferes with the enjoyment of life or property
  2. Creates a public or private nuisance
  3. Is a hazard to public safety
  4. To burn any of the following materials:
    1. Rubber products
    2. Tires
    3. Plastic
    4. Wet garbage
    5. Disposable diapers
    6. Petroleum & petroleum treated material
    7. Asphalt or industrial waste

Permit holders are responsible for fires they start. Permit Holders may be liable for costs incurred in supressions of and or damage to property of others. It is the responsibility of the permit holder to notify the Fire Department immediately in the event the permit holder loses control of the fire.

Open burning Violations can result in penalties of up to $10,000.00 per day.

ORS 478.965 allows for the district to recover costs of suppressing unlawful fire and attorney fees.

Unlawful fire identified under ORS 477.740 as:

  1. Unlawful set on fire.
  2. Intentionally or negligently allow fire to escape
  3. Accidentally set or allow to escape from control without extinguishing
  4. Has knowledge of a fire burning and fails or neglects to make effort to control
